A Denial of Justice Against Mendacious French Health Minister

ER Editor: The Court of Justice (CJR) in France is there specifically to try cases against government ministers. In this case, a prominent professor-doctor in France, Professor Christian Perronne, formerly in charge of France’s vaccination programs (long before Covid), and head of independent media outlet, Xavier Azalbert, are filing charges against France’s current health minister, Aurelien Rousseau, who is not a medical doctor(!), for making false statements to the public about the efficacy and safety of the disastrous Covid vaccines. Remarkably, the judge has effectively ruled against Perronne and Azalbert and FAILED TO GIVE A SET OF LEGAL REASONS WHY. French justice is about as bad and as politically motivated as German justice. It’s what the French would call ‘hallucinant’.

Denial of justice at the CJR: Perronne and Azalbert file a complaint against its seven magistrates

REPORTING – Professor Christian Perronne and Xavier Azalbert filed a complaint on October 6, 2023 against the health minister for comments made on France Inter at the microphone of Lea Salame on October 3.

Indeed, on the occasion of the launch of the vaccination campaign, the Minister of Health had told the journalist: “The vaccines against Covid are effective” and that there were “no side effects”. In addition to the initial complaint,  two additional complaints have been filed by collectives or associations for identical reasons.

In a letter dated 16 October 2023, received on Monday, 30 October 2023, the court of justice of the Republic informed the parties “to file the complaint without action” because this one “does not include’ elements likely to characterize a crime or misdemeanor committed by the Minister in the exercise of his functions“.

This decision is astonishing both in form and substance.

On the merits, Christian Perronne and Xavier Azalbert had made unfailing factual arguments that the minister cannot ignore. Namely that:

  • L’ANSM (National drug safety agency) had identified more than 200,000 side effects of Covid vaccination, 25% of which were serious;
  • L’ONIAM (Office national d’ indemnification des accidents medicaires) has already compensated more than 70 victims of the side effects of covid vaccination (declaration to the Senate of the Director of’ONIAM after a question of senator Muller-Bronn) ;
  • L’OPECST (Parliamentary Office for the Evaluation of Scientific and Technological Choices), during the investigation of side effects, recognized the latter and the pharmacist Amine Umlil recalled the rules that are required for such pharmaceutical products ;
  • Worldwide, and particularly in the United Kingdom, the effectiveness of vaccines has been strongly questioned and the side effects are proven;
  • Azalbert and Perronne, administrators of the association Bon Sens, made a voluntary intervention at the request of Laurent Toubiana, who wanted to obtain the all-cause mortality figures by vaccination status and age group, which the Ministry of Health refuses to provide, claiming a disruption of the service.

On form, the CJR did not provide the report referred to in the decision. Christian Perronne and Xavier Azalbert and Perronne had requested this report. No response so far.

However, the CJR’s decision does not include any statement of reasons. And this is the main problem: a court decision must be reasoned in order to avoid arbitrariness (this is provided for by both the Civil Code and the Penal Code). A statement of reasons allows the parties to understand the decision. In the present case, the CJR’s legal decision is therefore incomprehensible, thus constituting a denial of justice. Furthermore, the decision rendered does not include any avenue of appeal. 

Refusing to deliver justice and continuing with denial after warning or injury from one’s superiors is punishable by a fine of 7,500 euros and a ban on the exercise of public functions for a period of five to twenty years.

In the meantime, the Minister of Health did it again twice after his statement to France Inter, once by confirming it with a tweet, then on November 3 through a communication from the Ministry of Health saying that vaccines were safe.

Translation: Pr. Perronne and France Soir are taking me to the CJR. The motive (if I understand correctly): to have said that messenger RNA vaccines against Covid are safe and effective… What can I say? other than that mRNA vaccines are safe, effective and essential to protect the most fragile…

ER: The government notice below urges people to get a double (or two-in-one) vaccination against Covid and the flu. And ‘sans risque’ (without risk). Incredible.

Faced with what appears to be a recurrence of the problem by the Minister of Health on such an important subject, Christian Perronne and Xavier Azalbert presented themselves on Friday, November 3 at the police station on rue Fabert in the 7th arrondissement to file a complaint against the seven magistrates having rendered the decision of the CJR (the composition of the CJR was renewed on October 18 Editor’s note): President Nicole Planchon, Monique Saliou (Court of Auditors), Claude Bellenger (Court of Cassation), Edmond Honorat (Council of State), Vincent Feller (Court of Auditors), Alain Menemenis (Council of State) and Vincent Turbeaux (Court of Cassation).

Find the declaration of Christian Perronne and Xavier Azalbert as they left the police station, where they were very well received by an officer who confirmed to them that the police officers, even if they had not had any obligation to be vaccinated, had indeed been “strongly encouraged” to do so.
