In a case that is making a lot of noise, Professor Perronne and Xavier Azalbert, director of editorial and publication of France-Soir, recently filed a complaint with the Court of Justice of the Republic (CJR) against the Minister of Health, Aurélien Rousseau.
The plaintiffs claim that the minister deliberately spread false information regarding the side effects of Covid-19 vaccination during an interview on France-Inter.

On October 3, 2023, during an interview on France-Inter, the Minister of Health affirmed that there were no side effects of Covid-19 vaccination, which aimed to encourage the new vaccination campaign. Journalist Léa Salamé quickly questioned the minister about this statement, asking him how he could convince people reluctant to be vaccinated, particularly those over 60 who had received little vaccination the previous year.
The minister’s response was clear:
“We have a vaccine which is more effective than last year’s, there are no side effects, so we have to go for it!’
However, this assertion was strongly contested by Professor Perronne, Xavier Azalbert, and the BonSens.org association, who are administrators of the latter (ER: the BonSens organization, which has been very effective acting on behalf of citizens’ concerns).
Translation: Only 20% of the over-60s eligible for the new dose of Covid vaccine had been vaccinated last year. “We have a vaccine that is more effective than last year’s, and there are no side effects,” assures Health Minister Aurélien Rousseau.

The complainants believe that the minister’s comments are misleading in light of the scientific information available in many countries and official documents from French and European health authorities. They filed a complaint for “attempted fraud in consent to vaccination against Covid-19,” alleging that the minister used fraudulent maneuvers to encourage people to be vaccinated.
The plaintiffs’ lawyer, Me Protat, said the legal action aimed to restore the truth of the figures so that everyone can make an informed decision regarding vaccination. He also expressed concern that if the minister had succeeded in convincing people to get vaccinated based on false information, their consent would have been biased.
The issue of media integrity was also raised in this case. Me Protat criticized journalist Léa Salamé for not having contradicted the minister on his statements, stressing that it was his duty, as a journalist dealing with a subject of general interest, to respect the Munich Charter by providing complete and impartial information for listeners.
