PARIS — French authorities on Wednesday indicted Telegram CEO Pavel Durov with six charges related to illicit activity on the app.
Durov was also released from custody on a €5 million bail. He is forbidden from leaving France and must check in at a police station twice a week.
The charges include complicity in managing an online platform “in order to enable an illegal transaction in organized group,” and refusal to cooperate with law enforcement authorities, the Paris prosecutor’s office said in a press release.

Durov was also charged with “complicity in the offenses of making available without legitimate reason a program or data designed for… organized gang distribution of images of minors presenting child pornography, drug trafficking.”
Telegram “appears in multiple cases involving various offenses (child sexual abuse offenses, trafficking, online hate),” the prosecutor’s office wrote, pointing to “Telegram’s almost total failure to respond to judicial requests.”

Telegram: End of custody for Pavel Durov

The founder of Telegram came out of custody on August 28, in the early afternoon, after being detained for nearly four days. According to Politico, two arrest warrants were issued in late March by the French authorities against Pavel Dourov and his brother Nikolai.
After more than 90 hours in police custody, the founder of the application Telegram Pavel Durov came out of police custody on August 28. He was transferred to a judge in the early afternoon, French media reported. According to information from BFMTV, the investigating judge ended the police custody of the Franco-Russian entrepreneur with a view to a preliminary examination and a potential indictment.
A video of his exit of premises the national anti-fraud office (Onaf), where he was retained, was widely disseminated on social networks.

The news website Politico revealed on August 28 that Pavel Durov’s brother Nikolai was also the subject of am arrest warrant issued on March 28 by the French judicial system.

These warrants were reportedly issued as part of an investigation by the cybercrime section of the Paris prosecutor’s office. The Durov brothers were placed on the wanted list, with a court request to identify one of the Telegram users unanswered. According to Politico, there could be talk of a case involving underage girls and pornographic images.
The two brothers are thus implicated for complicity in possession, distribution, offer and access to pornographic images of minors in an organized group. According to the same source, Pavel Durov is accused of not having co-operated with the French judicial system. Telegram vice president Ilia Perekopsky is mentioned in the case, but it is not clear whether there is an arrest warrant against him.
A source from the Press Agency RIA Novosti within the Paris prosecutor’s office reported that only Pavel Durov was currently involved in the Telegram case. Solicited by RT, the prosecutor’s office declined to comment on the information regarding the arrest warrant issued against the founder of Telegram, citing the secrecy of the investigation. He added that a new press release on the continuation of the procedure would be issued «probably at the end of the day».

Et, en 2024, faire poursuivre cette même personne pour ces mêmes faits et le menacer de vingt ans de prison ?
Entre 2021 et 2024, le protocole de Telegram n’a pas changé. Le comportement de ses équipes n’a pas changé. Sa coopération avec les autorités françaises n’a officiellement pas changé.
Nous sommes face à exactement les mêmes faits.
Le parquet, qui a demandé l’ouverture d’une information judiciaire contre Pavel Durov le lendemain des élections législatives, met en oeuvre la politique pénale édictée par le gouvernement.
Nous avons donc pouvoir exécutif qui, en 2021, a considéré que ce que faisait Pavel Durov avec Telegram rendait des services à la nation de telle façon que cela justifie que lui soit octroyée à titre exceptionnel la nationalité ;
Et dont le parquet, chargé d’exécuter sa politique pénale, décide en 2024 que ces mêmes faits sont de nature à lui faire encourir 20 ans de prison.
Cela pose des questions gravissimes en ce qui concerne notre rapport à l’Etat de droit.
Que se passe-t-il ? Qu’est-ce qui se joue, et qu’est-ce que l’Elysée a à cacher ? A quoi joue la magistrature française, et pourquoi se laisse-t-elle, une énième fois, instrumentaliser ?
Il ne peut y avoir d’explications à ce qui se joue autres que politiques.
Emmanuel Macron, qui est peut-être le plus grand utilisateur de Telegram en France, fait passer ses communications confidentielles depuis 2014 au moins sur cette plateforme.
Il sait que les serveurs de Telegram ont accueilli les boucles non-chiffrées que lui et ses conseillers ont créées, non seulement pour donner des instructions à des magistrats et des policiers hors hiérarchie sur les affaires les plus sensibles (concernant des opposants, des crises sociales majeures comme les gilets jaunes, etc) ; organiser leur mouvement politique, orchestrer les fuites à la presse d’informations couvertes par le secret ; mais également pour tout ce qui a trait à leur intimité.
Ce même Président qui a toujours refusé d’expliquer pourquoi il avait octroyé la nationalité à Pavel Durov s’est senti obligé de prendre la parole publiquement pour prétendre que ce qui se passait n’avait rien à voir avec la politique.
C’est ridicule, et c’est absurde.
D’autant que certaines des infractions pour lesquelles M. DUROV est interrogé sont non seulement tombées en parfaites désuétudes, mais justifieraient, en ce qui concerne par exemple les infractions liées aux protocoles cryptographiques, de poursuivre tous les dirigeants de la Silicon Valley (Marck Zuckerberg, Elon Musk, etc), qui ont implémenté des protocoles de chiffrement à leurs plateformes sans formaliser de demande préalable à l’Etat français.
La désignation d’un juge d’instruction dans la foulée des élections législatives, n’est pas la moindre aberration en ces circonstances.
Cette désignation d’un juge, censément doté de garanties d’indépendance, ne semble en fait avoir eu pour objectif que de tenter d’habiller la mariée et d’instrumentaliser un magistrat du siège pour légitimer cette démarche.
La situation présente des enjeux de libertés, de principe, de contrôle démocratique sur le pouvoir exécutif, et enfin d’indépendance du pouvoir judiciaire majeurs.
Nous sommes face à un potentiel scandale d’Etat, dont les conséquences sont incommensurables.
La sécurité de l’Etat a-t-elle été mise en danger, du fait du comportement d’Emmanuel Macron ? Des acteurs étrangers disposent-ils de moyens de pression sur l’Elysée, qui aurait cherché à se prémunir et répliquer ? La justice française serait-elle instrumentalisée pour y remédier ?
Le communiqué visiblement embarrassé d’Emmanuel Macron ne saurait suffire.
C’est de la sécurité de la France et des Français qu’il en va.
Il nous faut des explications. Sans délais.
