The President of the National Rally (RN), Jordan Bardella, confirmed on Monday (June 24) that he wanted to abolish the right of birth in France, after the early legislative elections of June 30 and July 7, but did not return to his concept of “double border” or to the European pact on asylum and migration. 

A few days before the first round of the legislative elections, Jordan Bardella unveiled the RN’s programme in Paris on Monday morning, should the party come to power on the evening of July 7. 

Among the priorities of the far-right movement, there is – unsurprisingly – the question of migration, declared the “third major emergency”, after purchasing power and security. Jordan Bardella wants in particular a better “control of immigration” and to eliminate the right of birth. 

Until a few months ago, the right of birth allowed any child born in France to foreign parents to automatically obtain French nationality at the age of 18, if they were resident in the country when they came of age and had lived there for at least five years since they were 11. 

The immigration law, adopted in January 2024, has tightened the conditions of birthright citizenship, by repeating its automatic nature. A child born in France to foreign parents must now initiate a procedure between the ages of 16 and 18 to apply for French nationality.  

The RN president wants to go even further, by completely eliminating birthright citizenship.   

“The automatic acquisition of French nationality is no longer justified in a world of 8 billion people, and when daily evidence of our inability to integrate and assimilate is multiplying on our soil,” he said on Monday. 

The “emergency law” presented in the summer should remove this right, but also create a fund to replace State medical aid (AME) with Emergency Vital Aid (AUV). 

Eliminating birthright citizenship would be “formidable” 

From a legal point of view, eliminating birthright citizenship could prove complex, believes Smain Laacher, director of the Observatory on Migration and Asylum at the Jean Jaures Foundation. 

The emergency law should go before the Constitutional Council “which will not be an easy matter”, and, in the event of cohabitation, Emmanuel Macron will still have “his say”. 

According to him, the real consequences of such a measure would be more to be felt in the very definition of the French nation and in the unity of the country. 

“I fear the worst for immigrants,” he told Euractiv. “Removing the right of birth will radically change the place of immigration in French society, and the relationship between French society and immigration.”  (ER: Which is presumably the point)

Jordan Bardella wants people born in France to foreign parents to apply for French nationality when they turn 18, even though they have lived in France since birth. 

“This will create a series of discriminations and problems in terms of attachment to the French nation, and therefore to French nationality ,” Smain Laacher Warns. “Many people could say to themselves ‘France has rejected us, well we reject it too’ .”  (ER: Alas, this poor attitude to France is already evident in the suburbs packed with migrants, that we might term no-go zones.)

On the migration front, Jordan Bardella indicated that he wanted to refuse dual nationals positions of high responsibility, expel foreign delinquents and criminals and reinstate the offence of illegal residence. 

On the European side, Jordan Bardella did not directly return to his idea of ​​a “double border“, which should mean the establishment of controls at the French borders. (ER: Perhaps he should.)

On the other hand, the RN says it wants to “open negotiations with [its] European partners to reserve Schengen free movement for European nationals only.” 

A measure that would go against the asylum and migration pact, adopted in Brussels on May 14 …
