The Netherlands informs the EU about ‘opt-out’ plans, ‘something of the long breath’

Minister Faber of Asylum and Migration has sent the European Commission a letter stating that the Netherlands wants an opt-out when a new European treaty is introduced.
The cabinet had already announced several times that it would inform Brussels about this as soon as possible and now the minister has officially done so. An opt-out means that the Netherlands wants an exception for certain European rules in the field of migration.
Faber believes that the Netherlands should again discuss its own asylum policy. In her letter to European Commissioner Johansson, Faber also writes that as long as the Netherlands is no exception, the cabinet hopes for a rapid entry into force of the European migration pact. The countries of the EU have made all kinds of agreements in this regard, such as the immediate screening of migrants at the European external borders and the designation of asylum seekers as promising and underprivileged.
In an explanation, Faber acknowledges that the request for an opt-out is “something of the long breath”. But she doesn’t want to be held back by that. According to her, the demand for an opt-out is a signal that the Netherlands wants to do things differently. “I also want to try to get other Member States to get moving in the migration file.”
The Cabinet has even more asylum measures in store
The opt-out is one of the ways in which the cabinet wants to drastically limit migration. In the pipeline are still the use of exceptions that render parts of the Aliens Act inoperative and the submission of a temporary ‘asylum crisis law’.
An opt-out can only be arranged if a new EU treaty is negotiated within the EU. “You cannot escape EU law,” said a spokesman for the European Commission about that in May. “In the past, when the EU treaties were concluded, certain countries negotiated opt-outs. But we work here on the basis of existing treaties and legislation. ” (ER: We highlighted that in red for a reason.)

Hungary piggybacks on Dutch EU migration opt-out request
EU countries are legally bound to abide by the bloc’s migration and asylum rules.

Hungary will join the Netherlands in asking for an opt-out from the European Union’s migration policies, a government minister said Wednesday, in another sign of fracturing EU consensus around immigration.
The new Dutch government last week announced it was aiming to implement the “strictest asylum policy ever,” and submitted a request for an opt-out on some EU migration policies on Wednesday.
