Article 58 of the Constitution provides that:
“The Constitutional Council sees to the regularity of the election of the President of the Republic. It examines complaints and announces the results of the ballot.”
Moreover, in its decision n° 2022-184 -188 PDR of March 24, 2022, the Constitutional Council admitted that:
“By virtue of the general mission of monitoring the regularity of the election of the President of the Republic, which is conferred on it by article 58 of the Constitution, the Constitutional Council may exceptionally rule on petitions calling into question the election to come, in cases where the inadmissibility which would be opposed to these requests would risk seriously compromising the effectiveness of its control of the election, would vitiate the general progress of the electoral operations or would undermine the normal functioning of the public authorities. At least one of these conditions is met with regard to the decree of January 26, 2022 convening voters.’
It is because of these textual considerations and this recent case law that the Constitutional Council is asked, on the basis of fraud, to annul the results of the second round of the presidential election as officially announced by Mr. Laurent Fabius, as President of the Constitutional Council.

“Les fraudes à la présidentielle nourrissent de nombreuses inquiétudes et de nombreuses rumeurs hâtivement qualifiées de complotistes par la presse subventionnée qui a ouvertement appelé à voter Emmanuel Macron. Assez curieusement, le greffe du Conseil Constitutionnel semble avoir pris sur lui de déclarer irrecevable le recours déposé par plusieurs avocats, dont Carlo Brusa et Maud Marian (et de nombreux autres) sur la fameuse affaire France 2.

Les résultats français traités… aux USA !
Comme le souligne Maud Marian, co-rédactrice du recours contre le résultat aux présidentielles, cette lacune juridique pose de sérieux problèmes au vu de l’évolution, et surtout de l’informatisation du processus électoral lui-même.
S’agissant des machines à voter, son confrère Tarek Koraitem nous a déjà expliqué les problèmes juridiques gênants : installation illégale de machines à voter, flou sur les procédures de vérification de ces machines, incertitude complète sur leur fonctionnement et leur régularité.
S’agissant du traitement informatique des résultats après le dépouillement, Maud Marian soulève un autre point gênant : l’agrégation des résultats par le ministère de l’Intérieur échappe à tout contrôle, et se déroule sur des serveurs… hébergés aux USA, sous contrôle américain !” (…)
